Welcome to Number Games. These Terms of Use (the “Terms”) govern your access to and use of the website at numbergames.org (the “Website”) and the mobile games and applications we publish on Google Play and the Apple App Store (the “Apps”), together the “Services”. Please read them carefully. By accessing or using the Services you agree to be bound by these Terms and by our Privacy Policy. If you do not agree, you must not use the Services.

1. Who can use the Services

The Services are intended for a general audience. If you are under the age of majority in your country, you may use the Services only with the involvement and permission of a parent or legal guardian, who agrees to these Terms on your behalf and is responsible for your use. Parents and guardians should supervise children's use of the Internet.

2. The Services

Number Games provides free HTML5 browser games and mobile games, including math games, number games, puzzles and brain-training games. Games are provided for personal entertainment and educational enjoyment. We may add, change, suspend or remove any game, feature or part of the Services at any time without notice, and we do not guarantee that any particular game will remain available. The Services are funded by advertising and are provided free of charge.

3. Acceptable use

You agree to use the Services only for lawful purposes and in accordance with these Terms. You must not:

  • copy, download, scrape, frame, mirror, republish or redistribute games or other content from the Services, or embed our games on other websites or apps, without our prior written permission;
  • use bots, scripts or other automated means to access the Services, play games, submit ratings or reports, or generate traffic;
  • click on advertisements you are not genuinely interested in, encourage others to do so, or otherwise generate invalid ad impressions or clicks;
  • attempt to gain unauthorised access to any part of the Services, our servers or accounts, or probe, scan or test the vulnerability of our systems;
  • upload or transmit viruses, malware or any code of a destructive nature, or interfere with or disrupt the Services;
  • submit false reports or ratings, or send messages that are unlawful, abusive, harassing, defamatory, obscene or that infringe the rights of others;
  • reverse engineer, decompile or modify the Services or any game, except to the extent permitted by applicable law;
  • use the Services in any way that violates any applicable local, national or international law or regulation.

4. Intellectual property

The Services and their content — including the Number Games name and logo, website design, text, graphics, games, software, and the selection and arrangement of content — are owned by Number Games or by our licensors and game developers, and are protected by copyright, trademark and other intellectual property laws. Subject to these Terms, we grant you a limited, personal, non-exclusive, non-transferable, revocable licence to access and use the Services for your own non-commercial entertainment. All rights not expressly granted are reserved. Third-party trademarks, including Google Play and the Google Play logo (trademarks of Google LLC) and App Store and the Apple logo (trademarks of Apple Inc.), belong to their respective owners.

5. Games provided by third parties

Some games on the Website are developed by independent third parties and are published with their permission or under a licence. These games remain the property of their respective owners. We do not guarantee that third-party games are error-free, and we are not responsible for any external content or websites a game may link to.

6. Ratings, reports and messages

When you rate a game, report a problem or send us a message, you confirm that the information is accurate and does not violate these Terms. You grant us a worldwide, royalty-free licence to use, store and display ratings in aggregated form and to use your feedback to improve the Services, without any obligation to you. We may remove or disregard any rating or report at our discretion.

7. Copyright complaints

We respect the intellectual property rights of others and expect our users and partners to do the same. If you believe that any content on the Services infringes your copyright, please use the Report button on the game page and choose “Copyright issue”, or send a notice to [email protected] including: (a) your name and contact details; (b) a description of the copyrighted work you claim has been infringed; (c) the URL of the content on our Services; (d) a statement that you have a good-faith belief that the use is not authorised by the copyright owner, its agent or the law; (e) a statement that the information in your notice is accurate and, under penalty of perjury, that you are the owner or authorised to act on the owner's behalf; and (f) your physical or electronic signature. We will review valid notices promptly and remove or disable access to infringing content where appropriate.

8. Advertising

The Services display advertisements provided by third parties such as Google AdSense and Google AdMob. We are not responsible for the content of third-party advertisements or for the products, services or websites they promote, and any dealings you have with advertisers are solely between you and the advertiser. Information about how advertising partners use data is provided in our Privacy Policy.

9. Mobile Apps

Your use of our Apps is also subject to the terms of the store from which you downloaded them (Google Play Terms of Service or the Apple Media Services Terms and Conditions). If there is a conflict between these Terms and the store's terms regarding the store's rights, the store's terms prevail. For Apps downloaded from the Apple App Store, you and we acknowledge that: (a) these Terms are between you and Number Games only, not Apple Inc. (“Apple”), and Apple is not responsible for the App or its content; (b) your licence to use the App is limited to use on Apple-branded products that you own or control, as permitted by the Usage Rules in the App Store Terms; (c) Apple has no obligation to provide maintenance or support for the App; (d) to the maximum extent permitted by law, Apple has no warranty obligation with respect to the App, and if the App fails to conform to any applicable warranty you may notify Apple, which may refund the purchase price (if any); (e) Apple is not responsible for addressing any claims relating to the App, including product liability claims, claims that the App fails to conform to legal or regulatory requirements, or consumer protection claims; (f) Apple is not responsible for the investigation, defence, settlement or discharge of any third-party claim that the App infringes intellectual property rights; (g) you represent that you are not located in a country subject to a U.S. Government embargo or designated as a “terrorist supporting” country, and that you are not on any U.S. Government list of prohibited or restricted parties; and (h) Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you. 10. Disclaimer of warranties

The Services and all games are provided “as is” and “as available”, without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, non-infringement and uninterrupted or error-free operation. Educational content in our games is intended for practice and enjoyment and is not a substitute for formal instruction. Some jurisdictions do not allow the exclusion of certain warranties, so some of these exclusions may not apply to you.

11. Limitation of liability

To the fullest extent permitted by law, Number Games and its operators, partners and licensors will not be liable for any indirect, incidental, special, consequential or punitive damages, or for any loss of data, profits, goodwill or other intangible losses, arising out of or related to your use of or inability to use the Services, even if we have been advised of the possibility of such damages. Because the Services are provided free of charge, our total liability for any claim relating to the Services is limited to USD 50. Nothing in these Terms excludes or limits liability that cannot be excluded or limited under applicable law, including your statutory rights as a consumer.

12. Indemnity

You agree to indemnify and hold harmless Number Games and its operators from any claims, damages, losses and expenses (including reasonable legal fees) arising from your breach of these Terms or your misuse of the Services.

13. Suspension and termination

We may restrict, suspend or terminate your access to all or part of the Services at any time, without notice, if we reasonably believe you have breached these Terms or if required to protect the Services, other users or third parties. Sections that by their nature should survive termination, including sections 4, 7 and 10 to 15, will survive.

14. Governing law and disputes

These Terms are governed by the laws applicable in the jurisdiction in which Number Games is operated, without regard to conflict-of-law principles, and without depriving you of the protection of mandatory consumer laws in your country of residence. Before starting any formal proceedings, you agree to first contact us at [email protected] so that we can try to resolve the dispute informally.

15. General

If any provision of these Terms is found to be unenforceable, the remaining provisions will remain in full force. Our failure to enforce any right is not a waiver of that right. These Terms, together with our Privacy Policy, form the entire agreement between you and us regarding the Services. You may not transfer your rights under these Terms; we may transfer ours to a successor operator of the Services.

16. Changes to these Terms

We may revise these Terms from time to time. The updated version will be posted on this page with a new “Last updated” date. By continuing to use the Services after changes take effect, you agree to the revised Terms.
